LEGAL ASSESSMENT OF TRADE AND ECONOMIC SITUATIONS AS A MODERN APPROACH TO THE DEVELOPMENT AND IMPROVEMENT OF ONE'S OWN BUSINESS

Abstract

The authors of the article cite trade and economic situations (examples) from life, provide their own legal assessment of the latter, outline an approach to their solution as a way of developing and improving their own business in the light of legal and economic reform in Ukraine. Peculiarities in the legal assessment of trade and economic situations by the owner (or manager) of a trade establishment, as well as by an investigator (detective) in conducting a pre-trial investigation of criminal proceedings of the specified category are considered. An own (author's) methodology for solving a number of problematic situations that may arise during the implementation of entrepreneurial and trade activities is provided for consideration and discussion in general. For example, in the case of establishing the fact of embezzlement by using the difference in prices and drawing up forged documents for revaluation of goods; in the event that the owner (manager) of a store, supermarket, outlet discovers the facts of sales by sellers, trade managers of unaccounted for goods; when establishing the facts of embezzlement by employees of a store, outlet, supermarket. In connection with this, legal visions are provided in detailing the clarification of all the circumstances of the event. The need for effective cooperation between law enforcement officers and specialists in the field of economics is substantiated in order to qualitatively and objectively perform the tasks of criminal proceedings, comply with the general principles of the criminal process and improve the innovative policy of Ukraine in general. The authors defined and provided their own list of legal positions and the technique of possible opposition to procedural and legal techniques and tricks of unscrupulous employees of the trade establishment. The significance and evaluation of these short stories in the system of law and economy as a whole is revealed. Conclusions were made and recommendations were given regarding the coordinated application of the norms of the current legislation in the practical activities of the investigator, detective and owner of the trade establishment. Attention was drawn to the need for further scientific cooperation of scientists, specialists in the field of material, procedural law and economic sciences.
